Signature Properties is a trading division of Signature Global LTD an overseas property acquisition company based and incorporated in the United Kingdom. Wherever in the World you buy, or buy from, you, the purchaser, agree to be bound by the following terms and conditions of sale, under U.K.Law.

Property Offered for Sale.

The property we offer for sale is sourced by Signature Properties and offered for sale, to you, the purchaser under these terms and Conditions which form the full and final contract between you, hereinafter referred to as the Purchaser, and us, Signature Properties hereinafter referred to as The Company. The actual property purchased is being sold to you, the Purchaser, by the actual construction Company, their Agents, or sub agents, hereinafter referred to collectively as The Developer, in the territory to which the property relates. It is important for you to note that the actual sales and purchase agreement for the property to be purchased will exist between you, the Purchaser, and the Developer exclusively, and that The Company shall form no part off any legal undertaking between The Purchaser and The Developer concerning the terms and conditions of sale as stated by The Developer, nor shall The Company by liable for any variation, alteration, removal, redaction, or changes so otherwise made to the agreement for sale and purchase by the Developer post reservation of the property.

Due Diligence

The property offered for sale by The Company is offered and marketed to you The Purchaser in the form of our Property Release document and contains the information gained by The Company under its due diligence programme of property vetting. The information contained in the Property Release document is, to the best of The Company’s knowledge, correct and true and shall contain no statement which The Company knowingly knows to be false, misleading, or otherwise incorrect. However, the information contained within the Property Release Document will have been compiled, in full or in part, as a result of enquiries made within the territory to establish the factual information put forward as a proposal to purchase. As this information often has to be gleaned from Third Parties, The Company cannot accept any liability for any false, inaccurate, or otherwise incorrect information contained within the Property Release Document, where such information has had to be gleaned from such Third Parties.

Pre Reservation Form

It is a condition of sale that the Purchaser shall, and be required to, without exception, complete, sign, and deliver to The Company, a fully completed Pre Reservation form for each single unit of property that they wish to purchase. No verbal or otherwise delivered instructions to reserve units of property will be accepted by The Company to acknowledge reservation of property units. Whilst it is a condition of sale that this document be completed signed and returned to the Company to reserve property units, no formal reservation agreement will exist between the purchaser and the developer until such time as the reservation requirements of the Developer have been met and the submission of a pre reservation form to the company shall not bind the company to honour reservations of units made in this way until such time as the purchaser has met all of the property reservation requirements of the developer, Such terms and conditions of reservation as they shall exist shall be noted in the property release document. What you will have to pay us for our Services.

Legal Representation.

It is more important when purchasing property overseas than when purchasing in the UK that you have appropriate and professional legal assistance. This service is not provided by Signature Properties we will without exception, unless expressly stated by the Purchaser, at the time of pre reservation, refer your details as supplied to us at the time of pre reservation, to the International Property Law centre, a firm of UK based international property law experts for them to guide you through the legal process of purchasing property overseas. There will be a charge for this service; this charge is not covered by the charges levied against you, the Purchaser, by Signature Properties. The charges will vary from development to development and will be notified to you in writing by The International Property Law centre before you incur any bill from them. If you do not wish to make use of their services, please ensure that you notify us at the time of pre reservation of the property.

Financial Representation.

It is more important when purchasing property overseas than when purchasing in the UK that you have appropriate and professional financial advice. This service is not provided by Signature Properties. we will without exception, unless expressly stated by the Purchaser, at the time of pre reservation, refer your details as supplied to us at the time of pre reservation, to USHE (financial) a trading style of U.S.Holidays (Europe) Limited, a firm of UK based mortgage intermediaries for them to guide you through the financial process of purchasing property overseas. There will be a charge for this service; this charge is not covered by the charges levied against you, the Purchaser, by Signature Properties. The charges will vary from development to development and will be notified to you in writing by U.S.Holidays (Europe) Limited before you incur any bill from them. If you do not wish to make use of their services, please ensure that you notify us at the time of pre reservation of the property.

Rejection of Pre Reservations.

The Company reserves the right to refuse or withdraw any pre reservation of property from a Purchaser without giving reason at any time. If such a withdrawal of pre reservation is made post pre reservation, the purchaser shall be entitled to a full refund of any fees paid to The Company for such a pre reservation within 14 days of such withdrawal of a pre reservation.

Late Payment

The Company reserves the right to apply late payment penalties to invoices unpaid within 28 days of the date of the original invoice. If any invoice raised by the Company remains unpaid by the Purchaser 28 days after the date of the original pre reservation, this will trigger a reminder letter to the purchaser for payment of the invoice and then every seven days thereafter until such time as full payment of the face value of the invoice is received. Each such late payment reminder will be billed to the Purchaser at the rate of £50.00 plus VAT on each occasion for each invoice outstanding.

Refund of Fees.

If we charge you a fee for the pre reservation of a property, then there shall be no refund of fees owed if the purchase is unable to proceed with the purchase of the property for any reasons beyond the normal reasonable control of the Company, it is the responsibility of the Purchaser to ensure that they are financially in a position to proceed with the purchase of a property through to completion before pre reservation of that property.
